Overseas buyers

Buying One Park Lane from overseas.

Australia has banned foreign buyers from purchasing established homes until 30 June 2029. New dwellings are outside that ban, and foreign buyers may still purchase them with foreign investment approval. One Park Lane is a new dwelling.

Can foreign buyers still purchase property in Australia?
Yes, in limited categories. A ban on foreign purchases of established homes began on 1 April 2025 and was extended in the 2026–27 Budget to 30 June 2029. It applies to foreign persons, temporary residents and foreign-owned companies. Newly built dwellings bought from a developer are outside that ban, and One Park Lane is a new dwelling.
Do I need my own foreign investment approval?
Foreign persons generally need approval before buying residential property in Australia, whatever the price. Applications are made through the Australian Taxation Office and carry a fee scaled to the purchase price. A developer can hold a New Dwelling Exemption Certificate covering a project, and where one is in place an individual buyer may not need to lodge their own application. Ask us for the current position on One Park Lane when you enquire.
What extra duty do foreign buyers pay in Queensland?
Queensland charges additional foreign acquirer duty of 8% on the foreign buyer’s interest, on top of standard transfer duty. Allow for it from the start.
Can temporary residents and visa holders buy?
Your eligibility, approval pathway and timing depend on your citizenship, your visa and the structure you buy in. Confirm your own position with your legal and tax advisers before you commit.
Can I buy from Hong Kong, Singapore, the UAE or elsewhere overseas?
Yes. The rules turn on your status as a foreign person under Australian law, and where you live does not change them. Overseas enquiries are answered personally, and appointments by video call are available across time zones.

General information only, current at 12 October 2026. It is not legal, tax or financial advice. NextKey does not obtain foreign investment approval for buyers. Foreign investment rules, application fees and duty rates change; check your position with your own advisers, the Australian Taxation Office and the Queensland Revenue Office.
